California Proposition 65

What Proposition 65 Is

California's Proposition 65, formally known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires businesses to provide warnings to California consumers regarding certain exposures to chemicals that the State of California has identified as causing cancer, birth defects, or other reproductive harm.

The Proposition 65 list includes hundreds of naturally occurring and synthetic chemicals. Some listed substances, including certain heavy metals, may occur in foods, plants, and dietary supplement ingredients as a result of their natural presence in the environment.

California has established exposure-based "safe harbor" levels for many listed chemicals. A Proposition 65 warning may be required when anticipated exposure exceeds the applicable level, unless an exemption or other provision of the law applies. For chemicals listed as causing reproductive harm, the Maximum Allowable Dose Level is generally set at one one-thousandth of the level shown to produce no observable reproductive effect. For cancer-causing chemicals, California instead uses a No Significant Risk Level based on an estimated risk of no more than one excess cancer case per 100,000 people exposed over a 70-year lifetime.

A Proposition 65 warning does not necessarily mean that a product violates federal safety standards or that the FDA has determined the product to be unsafe. Proposition 65 is a California right-to-know law with requirements that are separate from federal dietary supplement regulations.

Our products are manufactured in facilities subject to applicable dietary supplement manufacturing requirements. Where available, we review testing information and Certificates of Analysis provided by our manufacturing partners.

Where a Proposition 65 warning is required for a product sold to California consumers, we provide the applicable warning in accordance with California requirements.
